1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of ondinesleep.com (the "Site") and all related products and services provided by Ondine ("we", "us", "our"). By accessing the Site or placing an order, you agree to be bound by these Terms.

2. Eligibility

You represent that you are at least the age of majority in your jurisdiction and have legal capacity to enter into a binding contract. Orders for resale or commercial redistribution require our prior written agreement.

3. Products and Claims

Ondine products are bedding and sleep accessories intended for general comfort use. Statements on the Site describe the physical properties and comfort characteristics of our products. Ondine products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Customer testimonials reflect individual experiences and are not a guarantee of the results you will experience.

4. Pricing, Availability, and Errors

Prices and availability are subject to change without notice. We reserve the right to correct typographical, pricing, or description errors and to cancel any order placed in reliance on such errors; if your payment method was charged for a canceled order, we will issue a full refund.

5. Orders, Payment, and Shipping

By placing an order, you authorize us to charge your selected payment method for the full order amount, including taxes and shipping. Orders are subject to acceptance; we may decline or cancel any order at our discretion. Shipping is governed by our Shipping Policy.

6. Refunds and Returns

Refunds and returns are governed by our Refund Policy, which provides the 100-Night Cool Guarantee on every Ondine product.

7. User Conduct

You agree not to use the Site for any unlawful purpose, interfere with its operation, attempt unauthorized access, or transmit harmful code. We may terminate access for violations.

8. Intellectual Property

The Site and all its content (text, graphics, photographs, logos, and design) are owned by or licensed to Ondine and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

9. User Content

If you submit reviews, photographs, or other content to us, or post such content on social media using our branded hashtags, you grant Ondine a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, and display that content in connection with marketing. You represent that you own or have all necessary rights to the content you submit.

10. Third-Party Services and Links

The Site integrates third-party services (including Shopify, payment processors, shipping carriers, and analytics providers). We are not responsible for the content or policies of any third party.

11. Disclaimers

The Site and services are provided "as is" and "as available." To the maximum extent permitted by law, Ondine disclaims all warranties, express or implied, except those expressly granted in our Refund Policy. We do not warrant that the Site will be uninterrupted, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Ondine's total aggregate liability arising out of or relating to your use of the Site or products shall not exceed the greater of (a) the amount you paid to Ondine in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100). Ondine shall not be liable for indirect, incidental, consequential, special, or punitive damages. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Ondine and its officers, employees, and agents from claims arising out of your use of the Site, your violation of these Terms, or your violation of any third party's rights.

14. Governing Law and Dispute Resolution

Any dispute that cannot be resolved by good-faith negotiation within thirty (30) days of written notice shall be resolved by binding individual arbitration. You and Ondine waive the right to a jury trial and to participate in any class action. Either party may bring a claim in small claims court for claims within that court's jurisdiction. You may opt out of this arbitration agreement by written notice to hello@ondinesleep.com within thirty (30) days of first accepting these Terms.

15. Severability; Entire Agreement; Modifications

If any provision is held invalid, the remainder remains in effect. These Terms, together with our Privacy, Refund, and Shipping Policies, constitute the entire agreement. We may revise these Terms; revisions are effective when posted.
